1. Introduction
These Terms and Conditions (“Terms”) apply to the use of this Website and to any services provided by Kimber & Co Construction Pty Ltd (“Kimber & Co”, “we”, “us”, “our”).
By accessing our Website or engaging our services, you agree to be bound by these Terms.

2. Services
Kimber & Co provides shed construction services, concreting, project management, earthmoving services and equipment hire services in Queensland.
All services are subject to formal quotation, written acceptance, and contractual agreement.


3. Quotes & Pricing

  • Quotes are provided based on information supplied by the client.

  • Quotes are valid for the period stated on the document (or 30 days if not stated).

  • Pricing may change due to supplier cost changes, site conditions, material availability or scope adjustments.

  • Any variations requested or required during the project will be quoted and approved before proceeding.

 

4. Client Responsibilities
Clients are responsible for:

  • Supplying accurate site and project details

  • Obtaining required approvals unless otherwise agreed

  • Ensuring safe and reasonable site access

  • Complying with local council, legal and safety requirements

 

5. Equipment Hire
If hiring equipment from Kimber & Co:

  • Equipment remains the property of Kimber & Co at all times

  • The hirer is responsible for safe use, compliance, and correct operation

  • The hirer is liable for damage resulting from negligence or misuse

  • Additional conditions may apply under hire agreement contracts

 

6. Payment Terms

  • Payment terms will be detailed in your contract or invoice

  • Deposits may be required prior to commencement

  • Late payments may incur additional charges

  • Failure to pay may result in suspension of services and/or recovery action

 

7. Cancellations

  • Cancellations must be submitted in writing

  • Fees may apply depending on timing, supplier orders and work already completed

  • Refunds are handled in accordance with Australian Consumer Law

 

8. Warranties & Australian Consumer Law
Nothing in these Terms limits your rights under the Australian Consumer Law.
Kimber & Co provides workmanship guarantees where applicable. Product warranties are provided by the manufacturer or supplier.

 

9. Liability
Kimber & Co is not liable for:

  • Delays outside our control

  • Damage resulting from incorrect client information

  • Loss resulting from misuse, poor maintenance or unauthorised modifications

  • Indirect or consequential losses

Our liability is limited to the fullest extent permitted by Australian law.

 

10. Website Use

  • Website content is general information only and not professional advice

  • We do not guarantee accuracy or availability at all times
